TAKE NOTICE that this action has been commenced against you
in the Court Office at Harris Street, San Fernando, by virtue of
Fixed Date Claim Form and Statement of Case, intituled Claim
No. CV 2017-00334 in which the Claimant Scotiabank Trinidad
and Tobago Limited with its registered office at Nos. 56-58
Richmond Street, Port of Spain, in the Island of Trinidad, claims
against you the following::
1. The said sum of $646,962.86 and $4,424.84 representing
principal balance and late fees respectively;
2. Interest outstanding as at 27th January, 2017 in the sum of
$139,144.78 together with agreed interest at the agreed rate
of 8.00% or $141.80 per day from 28th January, 2017 as
well after as before judgment.
3. Possession of ALL THAT Town House (including the land on
which the same stands) forming part of the development
property situate at Mount Hope, in the Ward of St. Ann
in the Island of Trinidad and described in the First Scheudle
to the said Lease and being one of the Townhouses and
known as Townhouse No. 23A Mount Hope Villas together
with the garden area forming part of the development
property allocated to and intended to be enjoyed with
the said Townhouses All which said Townhouse and garden
area are delineated and shown numbered 23A in the
Plant marked "A" annexed to Deed registered in the
protocol of deeds as No. 20410 of 1998 and thereon
coloured pink together with all sewers drains pipes wires
ducts and conduits used solely for the purposes of the said
Townhouse but no others.
5. Such further and/or other relief.
AND FURTHER TAKE NOTICE that by order made on the 10th
March, 2017 by the Honourable Mr. Justice Kokaram the Claimant
was directed to effect service of the Fixed Date Claim Form and
Statement of Case in this action by an advertisement in a local
daily newspaper of general circulation in Trinidad and Tobago
once per week for two consecutive weeks.
IF YOU DESIRE to defend this action you must state this, before
the expiration of fourteen (14) days from the date of the
second advertisement, by lodging an Appearance to the Fixed
Date Claim Form (Form 4) at any Court Office of the Supreme
Court (Hall of Justice, Knox Street, Port of Spain (tel. 223-1060),
Supreme Court, Harris Street, San Fernando (tel. 652-2152/
2869/3771) of the Supreme Court, Bacolet Street, Scarborough,
Tobago (tel. 639-2640) (copies of Form 4 are available at any of
the said Court Offices).
You may obtain copies of the Fixed Date Claim Form, Statement
of Case and all related documents at the Court Office of the
Supreme Court, San Fernando or from the Claimant's Attorneys
at Law, Messrs. Hobsons, Third Floor, Sagicor Centre, Nos. 21-25
Independence Avenue, San Fernando.
AND ALSO TAKE NOTICE THAT the fixed date claim is adjourned
to the 26th May, 2017 at 10:30 a.m. in Courtroom SF 09 at the
Supreme Court, Harris Street, San Fernando.
AND FURTHER TAKE NOTICE that in default of an Appearance
to the Fixed Date Claim Form or your Defence, the Court may
proceed in your absence and make any order it consider
appropriate, including entering Judgment in default.
