For the first time of its 14 years of existence, the
Equal Opportunity Commission has successfully
prosecuted a businessman for failing to comply
with their requests for information on a complaint
brought by a former employee.
Vivek Dinanath, who operates a store at Island
Mall, Southern Main Road, Chaguanas, was fined
$135,000, for failing to respond to three requests
from the commission between last November 27 and
when his trial was concluded on April 10.
The fine was calculated at the rate of $1,000 for
each day Dinanath failed to comply. In default he
will serve 24 months in prison with hard labour.
The charge fell under Section 36 of the Equal
Opportunity Act, a piece of legislation which seeks
to prohibit certain types of discrimination while pro-
moting equality of opportunity between people of
In a statement release yesterday, the commission
said it started an investigation last year after Dinanath s
former employee, Vence Skeete, made a complaint
to the commission.
In the case before Senior Magistrate Marcia Ayers-
Caesar the commission claimed it had sent Dinanath
The three T&T Imams, detained in
Venezuela, could be there until mid-May due
to Venezuela s terrorism act under which
they have been detained, says Imtiaz
Mohammed, one of their colleagues.
He said he and other colleagues of the imams
have learnt that people could be detained under
Venezuela s terrorism act for 60 days.
The men were among T&T nationals held
in Venezuela on March 19. Subsequently, 15
T&T women and children, who were among
those held, were released after efforts by T&T s
T&T had appealed against the Venezuelan
ruling that the men should be held without
recourse to bail.
Rear Admiral Richard Kelshall is spearheading
T&T s efforts on the issue. He said yesterday
the deadline for hearing T&T s appeal against
their detention without bail was 45 days from
the time they were detained on March 19.
He said nothing had materialised on the
On the reason for the delays Kelshall said
T&T had to await Venezuela s action but he
also noted riots and unrest over the past few
days in Venezuela.
In the interim, Mohammed said, colleagues
of the three Imams have been preparing doc-
uments for their recently-hired Venezuelan
He said that would necessitate sourcing con-
firmation from the National Security Ministry
in T&T that none of the men were involved
in the 1990 coup attempt in T&T, were not
among those held during the 2011 state of
emergency in T&T and held no criminal record.
Mohammed verified that none of them were
involved in the 1990 and 2011 situations or
had any criminal record.
He said the three had travelled annually to
Saudi Arabia for Hajj pilgrimages and had been
among those who were refused visas there last
November. He said two of the men were
employed at their mosques in T&T and costs
of their Venezuelan defence was expanding.

three notices which included details of
possible penalties which he might face for
failing to heed the requests.
When the requests were neither
acknowledged or responded to, the com-
mission s investigator Georgia-Rae Mottley
instituted the charges against Dinanath in
the Port-of-Spain Magistrates Court.
In defence Dinanath, who represented
himself, admitted he ignored the notices
but claimed he did so because he did not
employ Skeete and hence felt he had noth-
ing to respond to.
This excuse was not accepted by Ayers-
Caesar who advised Dinanath that if he
felt Skeete s allegation was misconceived
or untrue he should have still contacted
